Racing Incident Report
After being boxed, MEDIC CORPS became fractious, reared and got down behind. MEDIC CORPS was released from the gates, trotted up, examined by the Veterinary Surgeon and after the necessary consultations he advised that in his opinion the horse was suitable to race. Before being allowed to race again, MEDIC CORPS will be required to perform satisfactorily in a stalls test. On jumping, TOUCH OF CLASS shifted in, brushed YACHT MASTER which shifted ground and bumped with WELL EXPRESS. CITI CENTRE was slowly away. On jumping, SONGS OF PRAISE and PARADIS bumped. BEIJING DOLLAR left the gates very awkwardly and because of this lost considerable ground. The Stewards deferred the declaration of weighed-in. They were of the prima facie view that incidents had occurred in the Straight which cast doubt on whether GOLDEN CHOICE (Y T Cheng) should be declared 3rd placegetter. They were also concerned as a result of incidents in the Straight whether TOUCH OF CLASS (A Suborics) should be declared 2nd placegetter. They decided there was justification to have the matter resolved formally and openly at a protest/objection hearing (Rule 123). J Egan, the rider of YACHT MASTER, which finished 4th, also lodged a protest/objection against GOLDEN CHOICE being declared 3rd placegetter alleging interference to his mount over about the last 200 Metres. Following the conduct of a formal hearing, the Stewards on all the available evidence were of the opinion that as a consequence of GOLDEN CHOICE shifting in near the 200 Metres and crowding MEDIC CORPS onto YACHT MASTER, it had caused interference to YACHT MASTER. The Stewards formed the opinion that YACHT MASTER would have finished ahead of GOLDEN CHOICE had the interference which clearly took place not occurred. In sustaining the objection, the Stewards placed GOLDEN CHOICE immediately behind YACHT MASTER. The inquiry which was called for by the Stewards regarding TOUCH OF CLASS shifting out near the winning post was considered and bearing in mind that the Stewards inquiry has the same force and consequences of a protest/objection, they formed the opinion that had TOUCH OF CLASS not shifted out in the run to the winning post and hampered YACHT MASTER, YACHT MASTER would have finished in front of TOUCH OF CLASS. Accordingly TOUCH OF CLASS was placed behind YACHT MASTER. The final amended placings therefore became: SUPER SPRINT, 1st; YACHT MASTER, 2nd; TOUCH OF CLASS, 3rd; GOLDEN CHOICE, 4th. At the conclusion of the inquiry hearing, J Egan stated that he was not aware he had the rights to amend the protest/objection he lodged. Immediately after the race, he was of the view all his crowding had come from the outside. He was told it is permissible to amend his grounds of protest/objection at any time before a decision is reached. A Suborics (TOUCH OF CLASS) was found guilty of a charge of careless riding [Rule 100(1)]. The careless riding being that at about the 200 Metres he allowed his mount to shift in whilst riding it along when not clear of HIN YUEN'S UNICORN. As a result of this, HIN YUEN'S UNICORN lost running to which it was rightfully entitled and was checked. In respect of this incident, A Suborics was suspended from riding in races for a period to expire on Sunday 3 February 2002 (3 Hong Kong race days). A Suborics pleaded guilty to a further charge of careless riding [Rule 100(1)]. The careless riding being that in the run to the winning post he allowed his mount to shift out whilst riding it along. This caused YACHT MASTER to be carried outwards and as a consequence MEDIC CORPS lost running to which it was rightfully entitled and was severely checked on the inside of GOLDEN CHOICE. In respect of this incident, A Suborics was suspended from riding in races for a period to expire on Thursday 7 February 2002 on which day he may resume race riding (4 Hong Kong race days). The commencement of these suspensions was deferred until after the meeting at Happy Valley on Wednesday 23 January 2002. In respect of the crowding caused to YACHT MASTER after the 200 Metres when GOLDEN CHOICE shifted in, the Stewards were satisfied that the efforts made by Y T Cheng to prevent the crowding were acceptable and accordingly no action was taken. When questioned, W C Marwing (SUPER SPRINT) said he had ridden the horse twice on the track of recent times, the last work he gave the horse on the Riverside Gallop was in his opinion quite good. He said he discussed the riding tactics with Mr P F Yiu, the trainer, and it was thought SUPER SPRINT is a horse that keeps on about the same speed and today he was instructed to ride SUPER SPRINT either in the box seat or if he could lead he was to do so. W C Marwing said SUPER SPRINT left the gates satisfactorily, but then he did have to ride along to get into a forward position and once there SUPER SPRINT travelled kindly. The explanations submitted by W C Marwing were accepted. MEDIC CORPS was sent for clinical veterinary examination and testing. After the race, it was noted that BEIJING DOLLAR was bleeding from the off nostril. However, it was not classified as an official bleeder.
