Racing Incident Report

MENTOR left the gates very awkwardly and just after the start bumped with LUCKY LUCKY which also came out badly with its head up and shifted ground. MENTOR was further inconvenienced on jumping by BACK SEAT DRIVER which shifted out abruptly. On jumping, JUST IN TIME bounded in the air. In the early stages, SAINTLY PARTNERS proved very difficult to settle. After the 1000 Metres, K H Ting (LUCKY LUCKY) momentarily lost the use of his off side stirrup iron. Near the 500 Metres, SAINTLY PARTNERS shifted out from behind RIVER DANCE and bumped ALBELA, obliging that horse to race wide rounding the turn. Approaching and rounding the Home Turn, MONEY hung out. Approaching the 400 Metres, MISSION SEALED was checked severely and shifted in to avoid LUCKY LUCKY which was giving ground. The occurrence was accidental. The Stewards deferred the declaration of Weighed-In. They were of the prima facie view that an incident had occurred after the 200 Metres which cast sufficient doubt on whether SAINTLY PARTNERS should be declared second placegetter. They decided there were justification to have the matter resolved formally and openly at an objection hearing [Rule 151(iv)]. Apprentice C H Tse, the rider of SUPER TEAM, which finished 3rd, also objected against HANDOVER (M Kinane) being declared the winner and SAINTLY PARTNERS (W Woods) being declared 2nd, alleging interference to his mount after the 200 Metres. The Stewards on all the available evidence were of the view that after the 200 Metres SAINTLY PARTNERS shifted out, carried HANDOVER from running to which it was rightfully entitled and at about the 100 Metres HANDOVER as a result of being carried out became unbalanced, shifted ground and made contact with SUPER TEAM. As the Stewards were of the opinion that when HANDOVER bumped SUPER TEAM, it was as a result of being taken out by SAINTLY PARTNERS and indirect inconvenience was caused to SUPER TEAM from SAINTLY PARTNERS, the material extent of which exceeded the short head margin between those two horses at the finish. They therefore sustained this objection and placed SAINTLY PARTNERS immediately behind SUPER TEAM. The Stewards could not be satisfied, on the balance of probabilities, that any inconvenience caused to SUPER TEAM directly from HANDOVER had a bearing on SUPER TEAM finishing in front of HANDOVER. This objection was therefore overruled. Accordingly the amended placings became: HANDOVER 1st, SUPER TEAM, 2nd, SAINTLY PARTNERS, 3rd and MONEY 4th. After the decision in relation to the objection was presented to all parties, Mr L Fownes, Trainer of SAINTLY PARTNERS, said he had observed Apprentice C H Tse proceeding to the Jockeys Room before weighing in. Rule 140(iv) empowers the Stewards to disqualify a horse from a race if a rider does not present himself to be weighed in unless the Stewards can be satisfied that extraordinary circumstances exist. In this case, Apprentice C H Tse did present himself to be weighed in albeit after he had proceeded to the Jockeys Room for little more than one minute. Bearing in mind all the circumstances of this matter, the Stewards decided it was not appropriate to exercise their powers in accordance with Rule 140(iv) and Weighed-In was then semaphored. Subsequently Mr A S Cruz, the allocated Trainer of Apprentice C H Tse, explained that the Apprentice was clearly confused after the race with all the proceedings that were taking place. However, he acknowledged that in slightly different circumstances the repercussions could have been quite significant. Apprentice C H Tse was told it is in his interests and in the interests of the people for whom he rides to avoid an incident such as this. E Saint-Martin (LONGMARK) stated his instructions from a good gate had been to jump and lead if possible. He pointed out however immediately on leaving the gates he became concerned with the action of the horse, was not able to go forward as instructed. Before LONGMARK can race again, it will be subjected to an official veterinary examination. J Murtagh (MASCOT TREASURE) said he was asked to ride the horse along in the early stages and take up a forward position. It was hoped that JUST IN TIME which had drawn inside him would go forward and take him into the race. J Murtagh said MASCOT TREASURE left the gates satisfactorily, but was bumped by COSMO ONE, did not show the pace as anticipated and he was not able to carry out the instructions he was given. He said MASCOT TREASURE did not travel in the race as anticipated, racing with its head up in an awkward position and its ears back. He said in the Straight MASCOT TREASURE did make some ground from a long way back and to obtain running he changed course several times. SUPER TEAM was sent for clinical veterinary examination and routine testing. After the race, the Veterinary Surgeon reported that JUST IN TIME had sustained lacerations to both hind pasterns.
