Racing Incident Report

Before being presented in the Parade Ring, GOOD POWER had an adjustment made to its near side hind plate. About the 800 Metres, DIAMOND TALENTS got its head up, became unbalanced and shifted in abruptly away from GOOD POWER. As a consequence of this, DANEFACTOR was crowded and LUCKSWELL was checked and shifted out abruptly to avoid DIAMOND TALENTS. When LUCKSWELL shifted out, ACROBATIC was hampered and obliged to race wider. Some inconvenience was caused to WIN FOR LILY which was following. Also about the 800 Metres, LEGITIMATE became unbalanced when momentarily crowded inside MILLENNIUM SUPREME. Near the 600 Metres, LUCKSWELL shifted out from behind GOOD POWER. As a consequence of this, ACROBATIC was hampered and obliged to race considerably wider rounding the bend. About the 500 Metres, LUCKSWELL and ACROBATIC came together several times. The Stewards deferred the declaration of weighed-in. They were of the prima facie view that an incident had occurred in the Straight which cast sufficient doubt on whether GOOD POWER (F Coetzee) should be declared 3rd placegetter. They considered there was justification to have the matter resolved formally and openly at an objection hearing (Rule 123). R Fradd, the rider of DANEFACTOR, 4th placegetter, also lodged a protest/objection against GOOD POWER being declared 3rd placegetter alleging interference to his mount over about the last 100 Metres. Following the conduct of a formal hearing, the Stewards on all the available evidence were of the opinion that by continually shifting out under pressure and carrying DANEFACTOR from the running to which it was rightfully entitled GOOD POWER had caused interference to DANEFACTOR. The Stewards formed the opinion, bearing in mind the neck margin between the two horses at the finish, that DANEFACTOR would have finished ahead of GOOD POWER had the interference which clearly took place not occurred. In sustaining the objection, the Stewards placed GOOD POWER immediately behind DANEFACTOR [Rule 101(2)]. Accordingly the amended placings became WIN FOR LILY, 1st, DRAGON POWER, 2nd, DANEFACTOR, 3rd and GOOD POWER, 4th. F Coetzee was reprimanded and told he must stop riding and straighten. About 100 Metres out, MENDOZA was steadied when crowded by FISHERMAN'S CREEK (K H Ting) which shifted in. K H Ting was reprimanded and told in similar circumstances he must stop riding and straighten. S King (ACROBATIC) said approaching and rounding the Home Turn he was inconvenienced and carried considerably wider when LUCKSWELL shifted out. He said however in the Straight ACROBATIC did not stretch out as anticipated and over the concluding stages was very disappointing. ACROBATIC was sent for clinical veterinary examination and routine testing.
