Racing Incident Report

OCEAN ROAR and DOUBLE MASTER bumped at the start.
BOLERO began awkwardly.
From the outside barrier, SIGHT LOVER was taken across behind runners shortly after the start.
Despite being ridden along in the early stages, CHINA POWER failed to muster speed and shortly after the start was checked away from the heels of BRAVE BROTHER which got its head on the side and shifted out away from NAUGHTY BABY.
Near the 900 Metres, KING DERBY shifted in abruptly when travelling keenly and racing close to the heels of HURRY HURRY UP. When KING DERBY shifted in, DOUBLE MASTER was checked and lost ground when crowded onto the hindquarters of RED LUCKY STAR on a number of occasions. As a consequence, RED LUCKY STAR became unbalanced. As this incident was attributable to the racing manners of KING DERBY, no further action was taken.
Passing the 900 Metres, BRAVE BROTHER got its head on the side and shifted in abruptly away from NAUGHTY BABY which was shifting ground. SIGHT LOVER, which was following, was inconvenienced in consequence.
HURRY HURRY UP travelled wide and without cover until after the 600 Metres.
SIGHT LOVER was badly held up for clear running until approaching the 200 Metres.
Passing the 200 Metres, BRAVE BROTHER raced tight inside P J HALL (C Y Ho) which shifted in slightly under pressure away from NAUGHTY BABY. In this incident, BRAVE BROTHER was struck across the head by the whip of C Y Ho. CHINA POWER, which was racing to the inside of BRAVE BROTHER, was held up for clear running behind DOUBLE MASTER as a consequence. A short distance later, DOUBLE MASTER got its head on the side, shifted in towards the heels of HURRY HURRY UP and was awkwardly placed for some distance.
The Stewards deferred the declaration of weighed-in as they were of the prima facie view that an incident occurred over the final 100 Metres which cast doubt on whether NAUGHTY BABY should be declared the 5th placegetter. When there was no protest/objection lodged by D Whyte, the rider of BRAVE BROTHER, which finished 6th, the Stewards resolved that the matter should be the subject of a formal protest/objection hearing. After taking evidence from all parties concerned and after viewing the videos, the Stewards found that approaching the 50 Metres BRAVE BROTHER became unbalanced after being bumped by NAUGHTY BABY which got its head on the side and hung in. The Stewards further found that passing the 50 Metres NAUGHTY BABY continued to hang in, resulting in BRAVE BROTHER being further crowded inside NAUGHTY BABY. The Stewards found that BRAVE BROTHER was then not able to be ridden out over the concluding stages due to continued pressure from its outside being applied by NAUGHTY BABY and whilst there was a marginal shift out from BOLERO, they were of the opinion that this did not have any subsequent bearing on the incident. Having considered the short head margin between the horses at the end of the race and the manner in which BRAVE BROTHER was finishing off the race, the Stewards were of the opinion that had the incident which had clearly occurred not taken place that BRAVE BROTHER would have finished in front of NAUGHTY BABY. Accordingly, the protest/objection was sustained and the placings amended to read No. 5, HEARTS KEEPER , 1st; No. 10, OCEAN ROAR, 2nd; No. 2, SIGHT LOVER, 3rd; No. 12, BOLERO, 4th; No. 6, BRAVE BROTHER, 5th; and No. 9, NAUGHTY BABY, 6th. At a subsequent inquiry, D Whyte was fined a sum of $10,000 for breaching Rule of Racing 117(4) in that he failed to make an objection where reasonable grounds existed. In assessing penalty, the Stewards took into consideration that D Whyte had previously been penalized for breaching this Rule of Racing.
Near the 50 Metres, KING DERBY was steadied and shifted in across the heels of BOLERO which shifted out under pressure.
W M Lai (BOLERO) was reprimanded for raising his whip arm above the height of his shoulder.
Apprentice C Y Lui reported that it had been the intention for CHINA POWER to be ridden in a forward position, however, despite being ridden along, CHINA POWER did not show early speed.
When questioned regarding the disappointing performance of RED LUCKY STAR, O Doleuze stated that it had been intended to lead if possible, however, when RED LUCKY STAR began only fairly, the horse was not able to lead. He said nonetheless he obtained a good position on RED LUCKY STAR given that the race was run at a strong tempo. He added whilst RED LUCKY STAR became unbalanced when bumped on the hindquarters near the 900 Metres, he did not consider this to be an excuse for the horse’s disappointing run. He said whilst in the past RED LUCKY STAR had shown a good turn of foot, the horse tonight quickened only fairly when asked, however, quickly came under pressure and was most disappointing in the manner in which it gave ground in the Straight. He said the manner in which RED LUCKY STAR weakened indicated to him that the horse may have experienced internal problems. A veterinary inspection of RED LUCKY STAR immediately following the race did not show any significant findings. Before being allowed to race again, RED LUCKY STAR will be subjected to an official veterinary examination.

NAUGHTY BABY, HEARTS KEEPER and OCEAN ROAR were sent for sampling.
