Racing Incident Report

After arriving on course, Y Lerner, the declared rider of BULL'S EYE, advised the Stewards he would be unable to make the horse's weight. As such, the Stewards permitted W M Lai to be substituted as the rider of BULL'S EYE. As this was the second occasion in a short space of time Y Lerner had been found to be overweight, he was fined the sum of $8,000 [Rule 88(5)]. After arriving at the Start, STAY YOUNG, which kicked the rail in the Parade Ring, was examined by the Veterinary Surgeon who said in his opinion the horse was suitable to race. BULL'S EYE began awkwardly, got its head up and lost ground. On jumping, STAY YOUNG was crowded for room between SUPER KID and MERIDIAN STAR which on jumping got its head up and shifted in. Also on jumping, THE DUKE became unbalanced and lost ground after being bumped by OLYMPIC EXPRESS. MAGNIFIER was slow to begin. Making the turn at the 800 Metres, MERIDIAN STAR became unbalanced when racing tight inside OLYMPIC EXPRESS which in turn was racing tight inside THE DUKE. On straightening, HO CHOI was bumped by FIGURES which was endeavouring to shift to the outside of STAY YOUNG to find clear running. From shortly after straightening until near the 200 Metres, PERFECT PARTNER was held up and unable to obtain clear running between HO CHOI and SUPER KID. From the 400 Metres until near the 200 Metres, ROOSEVELT was held up and unable to obtain clear running between PERFECT PARTNER and FIGURES. After the 400 Metres, PALETTE NATURAL was steadied and shifted out away from the heels of OLYMPIC EXPRESS which was giving ground. After the 300 Metres, MERIDIAN STAR was shifted to the outside of THE DUKE to obtain clear running. P Payne (PERFECT PARTNER) pleaded guilty to a charge of careless riding [Rule 100(1)] in that near the 200 Metres he shifted his mount to the inside of SUPER KID when not clear of HO CHOI and FIGURES, causing both horses to be crowded for room and HO CHOI to lose its rightful running and be checked. ROOSEVELT, which was following HO CHOI, was hampered and shifted out in consequence. P Payne was suspended from riding in races for a period to expire on Monday 29 November 2004 on which day he may resume race riding (2 Hong Kong racedays). As P Payne is a retained rider, the Stewards acceded to a request from him that this suspension take immediate effect. In addition, P Payne was fined $15,000 in lieu of a suspension for a period incorporating one further raceday. The Stewards deferred the declaration of weighed-in as they were of the prima facie view that an incident had occurred after the 200 Metres which cast sufficient doubt on whether SUPER KID should be declared the 4th placegetter. After viewing the available videos and after the members of the Panel had expressed their opinions, the Stewards believed this was not an appropriate case to exercise their powers under Rule 123 and accordingly weighed-in was semaphored, confirming the Judge's placings. While it did not influence the decision of the Stewards, it should be noted that neither P Payne nor the connections of PERFECT PARTNER, 5th placegetter, lodged a protest/objection. The evidence disclosed that after the 200 Meters PERFECT PARTNER and STAY YOUNG were crowded for room inside SUPER KID which shifted in after initially being carried in by THE DUKE. As the Stewards believed THE DUKE had had a bearing on this incident, no action was taken. Throughout the race, SUPER KID travelled wide and without cover. After the race, G Schofield, the rider of OLYMPIC EXPRESS, said the horse was not striding out freely. OLYMPIC EXPRESS was sent for an official veterinary inspection. The horse was examined by the Veterinary Officer who said at this time there were no significant findings. Before being allowed to race again, OLYMPIC EXPRESS will have to perform satisfactorily in an official barrier trial and be subjected to an official veterinary examination. SUPER KID, THE DUKE and MERIDIAN STAR were sent for sampling.

After the race, Jockey G Schofield reported that OLYMPIC EXPRESS was not striding out freely. The horse was examined by the Senior Veterinary Officer. He said at that time there were no significant findings. OLYMPIC EXPRESS was again examined by the Senior Veterinary Officer at the stables of Trainer C S Shum this morning. He said at this time he noted the horse to be lame in the right front leg with a severe re-injury to the right front tendon. As previously advised, OLYMPIC EXPRESS will have to perform satisfactorily in an official barrier trial and be subjected to an official veterinary examination before racing again.
