Racing Incident Report

A BETTER DRAGON was withdrawn on 21.6.05 by order of the Stewards acting on veterinary advice (lame both fore) and was replaced by Standby Declared Starter RISING WIN (R Fradd). Before being allowed to race again, A BETTER DRAGON will be subjected to an official veterinary examination. MIRACLE DRAGON began awkwardly, bumped the inside gate of its stall and lost ground. ELFHELM was slow to begin. Approaching the winning post on the first occasion, MIRACLE DRAGON was steadied and shifted out when awkwardly placed between ELFHELM and SUNDAY DELIGHT which shifted in slightly. After this, MIRACLE DRAGON proved difficult to settle and became unbalanced. After the 600 Metres, HAPPY HEROES was steadied and shifted out to avoid the heels of METRO LEADER which was giving ground. On straightening, SUNDAY DELIGHT was bumped by AMBITIOUS MARJU which made the turn awkwardly and shifted out. Shortly after this, AMBITIOUS MARJU shifted in and was steadied away from the heels of ELFHELM. The Stewards deferred the declaration of weighed-in as they were of the prima facie view that an incident had occurred near the 100 Metres which cast doubt on whether TOUCH DOWN should be declared the second placegetter. O Doleuze, the rider of ELFHELM, 3rd placegetter, also lodged a protest/objection against TOUCH DOWN (D Whyte) being declared the 2nd placegetter alleging interference to his mount near the 100 Metres. The Stewards on all the available evidence were of the opinion that by shifting out near the 100 Metres causing ELFHELM to lose the rightful running to which it was entitled, TOUCH DOWN had caused interference to ELFHELM. The Stewards formed the opinion that ELFHELM would have finished ahead of TOUCH DOWN had the interference which clearly took place not occurred. Therefore the protest/objection was sustained and the Stewards placed TOUCH DOWN immediately behind ELFHELM. Accordingly the amended placings became 1st SUNDAY DELIGHT, 2nd ELFHELM, 3rd TOUCH DOWN, and 4th FRIENDSHIP. At a subsequent inquiry, D Whyte pleaded guilty to a charge of careless riding [Rule 100(1) in that at the 100 Metres he permitted TOUCH DOWN to shift out when not clear of ELFHELM, causing that horse to be crowded for room, lose its rightful running and be checked. D Whyte was suspended from riding in races for a period to expire on Thursday 30 June 2005 on which day he may resume race riding (1 Hong Kong raceday). The commencement of the suspension was deferred until after the Sha Tin racemeeting next Sunday 26 June 2005. In addition, D Whyte was fined $120,000 in lieu of a suspension for a period incorporating 3 further racedays. Throughout the race, METRO LEADER travelled wide and without cover and in addition hung out, then from near the 600 Metres gave ground. The performance of METRO LEADER, which tailed out, was considered unacceptable. Before being permitted to race again, METRO LEADER will have to perform competitively in an official barrier trial around a bend and be subjected to an official veterinary examination. SUNDAY DELIGHT and TOUCH DOWN were sent for sampling.
