Racing Incident Report

S de Sousa was found guilty of a breach of Stewards Instruction 22(3) in that he used his whip in an inappropriate manner on EAGLE WAY during that horse’s preliminary. S de Sousa was fined the sum of $10,000.
GOLD MOUNT and DINOZZO bumped shortly after the start.
From a wide barrier, CITRON SPIRIT was shifted across behind runners in the early stages.
A Badel (SIMPLY BRILLIANT) pleaded guilty to a charge of careless riding [Rule 100(1)] in that for some distance after the start he permitted his mount to shift in when not clear of EAGLE WAY, resulting in that horse, NORTHERN SUPERSTAR and SOUTHERN LEGEND receiving significant crowding and ultimately causing SOUTHERN LEGEND to lose its rightful running when checked away from the heels of HORSE OF FORTUNE approaching the 1700 Metres. A Badel was suspended from riding in races for a period to commence on Wednesday, 16 January 2019 and to expire on Monday, 21 January 2019 on which day he may resume race riding (2 Hong Kong racedays). In addition, A Badel was fined 25,000.
CITRON SPIRIT was badly held up for a run in the early part of the Straight and near the 250 Metres was shifted to the outside of DINOZZO to obtain clear running.
GOLD MOUNT was also held up for clear running in the early part of the Straight and near the 250 Metres was disappointed for a run between EAGLE WAY which was racing tight outside HORSE OF FORTUNE and SOUTHERN LEGEND.
After passing the winning post, at the conclusion of the race, SIMPLY BRILLIANT stumbled badly, resulting in its rider, A Badel, being dislodged. A Badel was subsequently examined by the Chief Medical Officer who reported that he was unfit to fulfil his remaining race riding engagement. After this incident, Officials inspected the relevant section of the track and found that, apart from one noticeable divot, the remainder of the racing surface in the relevant area was consistent with other sections of the track approaching and after this area. After remedial work was carried out on this one divot, the relevant section of the track was inspected by the Stewards and found to be suitable for racing.
When questioned, S de Sousa stated that in discussions with Mr J Moore, the trainer of EAGLE WAY, it was felt that TIME WARP would be able to dictate the tempo of the race as it was not anticipated that another horse would be able to show sufficient speed to pressure that horse in the early and middle stages. He said it was therefore felt that if EAGLE WAY were to be able to obtain a position in about midfield, this would provide EAGLE WAY with the opportunity to be positioned closer to TIME WARP so that the horse would not have too much ground to make up in the latter stages of the race. He said after being crowded for room for some distance after the start, he was left racing wide and he steadied his mount in an attempt to obtain a trailing position behind NORTHERN SUPERSTAR. He said after obtaining that position, he was unable to shift in further as SOUTHERN LEGEND had obtained the position one horse off the rail inside EAGLE WAY. He said after NORTHERN SUPERSTAR was able to shift in to a position one horse off the rail near the 1200 Metres, this resulted in EAGLE WAY being left racing in a three wide position without cover. He added it was not available for him to steady EAGLE WAY to shift in to race behind SOUTHERN LEGEND at this time as he would have had to unnecessarily restrain the horse and consequently EAGLE WAY was left racing three wide and without cover for the remainder of the race. A veterinary inspection of EAGLE WAY immediately following the race did not show any significant findings.

TIME WARP, SIMPLY BRILLIANT and CITRON SPIRIT were sent for sampling.
<10/1/2019 Additional Veterinary Report>The Veterinary Surgeon reported that GOLD MOUNT was lame in its left front leg on the morning after racing. Before being allowed to race again, GOLD MOUNT will be subjected to an official veterinary examination.
