Racing Incident Report

ARRIBA-ARRIBA was slowly away. On jumping, PO ON WIN was
severely checked when crowded between GO GET THEM and HIGHLAND
LEGEND which shifted out abruptly after being bumped by BRUIN SUPREME.
The check to PO ON WIN was one of considerable significance. However, the
Stewards were of the view it was accidental. In the early stages, BRUIN SUPREME
had a tendency to pull and throw its head about, then rounding the Home Turn hung
out. The Stewards deferred the declaration of weighed-in. They were of the prima
facie view that an incident had occurred in the Straight which cast sufficient doubt
on whether PO ON WIN should be declared 2nd placegetter. They decided there was
justification to have the matter resolved formally and openly at a protest/objection
hearing (Rule 123). Mr A T Millard, trainer of COURAGE STAR, and Apprentice
K K Lai, rider, sought permission to view the official videos as they were also of the
view that there might have been grounds for a protest/objection. After this viewing
had taken place, Mr Millard, as the trainer of COURAGE STAR, formally objected
against PO ON WIN (C Williams) being declared 2nd placegetter alleging
interference to COURAGE STAR about the 200 Metres. Following the conduct of a
formal hearing, the Stewards on all the available evidence were of the opinion that
as a result of PO ON WIN becoming momentarily unbalanced, dipping on two
occasions and shifting out away from BRUIN SUPREME, it had indirectly caused
crowding to COURAGE STAR which was racing between ALBELA and GO GET
THEM which was immediately outside PO ON WIN. The Stewards formed the
opinion that COURAGE STAR would have finished ahead of PO ON WIN had the
crowding which clearly took place not occurred, therefore they sustained the
protest/objection. In sustaining the protest/objection, the Stewards placed PO ON
WIN immediately behind COURAGE STAR [Rule 101(2)]. Accordingly the
amended placings became SMILING FOREST 1st, COURAGE STAR 2nd, PO ON
WIN, 3rd, and MANY HAPPY RETURNS 4th. It was subsequently established that
about the 200 Metres, PO ON WIN shifted to the outside of BRUIN SUPREME to
find running and go forward. A run was available for PO ON WIN, but it became
momentarily unbalanced, dipped on two occasions and shifted out away from
BRUIN SUPREME further than was necessary. As a consequence of this, crowding
was caused to GO GET THEM, COURAGE STAR and ALBELA which was
carried onto the heels of SMILING FOREST which shifted in slightly. This caused
ALBELA to be checked. The Stewards took the view that this was somewhat a
borderline case and by giving C Williams the benefit of the doubt, they did not
believe it was appropriate to proceed with the matter. However, C Williams was
told it is his responsibility to exercise care at all times. When asked about the
disappointing performance of EXCITING TIMES, D Whyte said before the race the
trainer had told him it was expected the horse would run well. He said he enjoyed a
good run in the race, but in the Straight EXCITING TIMES when put under pressure
put its head up and the horse was travelling so badly over the concluding stages he
was of the view it might have bled. He reported this to Mr A S Cruz, trainer of
EXCITING TIMES, after the race. He went on to say on pulling up EXCITING
TIMES was making an abnormal breathing noise.
