Racing Incident Report

PACKING ANGEL began awkwardly, shifted in and bumped the hindquarters of RUN AND WIN. W C Marwing (TRICCOLO) pleaded guilty to a charge of careless riding [Rule 100(1)] in that near the winning post on the first occasion, he allowed his mount to shift in when not clear of INDUBITABLY BLISS, causing that horse to lose its rightful running and be checked which in turn caused crowding to its inside to TOM'S FIRST and GLORIOUS LIGHT. In the circumstances, it was decided the appropriate penalty was for W C Marwing to be suspended from riding in races for a period to expire on Sunday 2 March 2003 on which day he may resume race riding (4 Hong Kong race days). The commencement of the suspension was deferred until after the meeting at Sha Tin next Sunday 16 February 2003. Passing the winning post on the first occasion, GLORIOUS LIGHT became unbalanced, shifted out and bumped TOM'S FIRST, causing that horse to be carried wider and in turn carried INDUBITABLY BLISS wider. Near the 1300 Metres, SIROCCO brushed the running rail. Making the turn at the 1200 Metres, GLORIOUS LIGHT shifted out. This caused TOM'S FIRST to be carried wider, resulting in INDUBITABLY BLISS, which was following TOM'S FIRST, being inconvenienced. Throughout the race, INDUBITABLY BLISS was obliged to race wide without cover. The Stewards deferred the declaration of weighed-in as they were of the prima facie view that an incident had occurred in the Straight which cast sufficient doubt on whether BOBO DUCK should be declared the 3rd placegetter. They decided there was justification to have the matter resolved formally and openly at a protest/objection hearing (Rule 123). D Whyte, rider of PACKING ANGEL, 4th placegetter, also lodged a protest/objection against BOBO DUCK (O Doleuze) being declared the 3rd placegetter alleging interference to his mount in the Straight. Following the conduct of a formal hearing, the Stewards on all the available evidence were of the opinion that shortly after straightening PACKING ANGEL endeavoured to improve into a run between BOBO DUCK and RUN AND WIN which was giving ground and that before PACKING ANGEL secured that run, BOBO DUCK shifted in, resulting in PACKING ANGEL being checked at about the 250 Metres when disappointed for running. Inconvenience was also caused to RUN AND WIN. As the Stewards were not of the opinion PACKING ANGEL had established clear running to the inside of BOBO DUCK at the time of the interference, the protest/objection was overruled. Accordingly the Judge's placings as semaphored were confirmed. Subsequently both O Doleuze and D Whyte were advised that in the circumstances no direct action would be taken as neither rider could be held fully responsible for the incident. G Schofield (TOM'S FIRST) said despite the interference the horse received in the early stages, it then travelled comfortably in the middle stages, however, when asked to improve on the latter part of the Home Turn, it failed to respond to his riding. He said following the race, the horse felt all right, however, considering the interference in which it was involved in the early stages, it might have knocked itself. Before TOM'S FIRST can race again, it will be required to pass an official veterinary examination. PACKING ANGEL, THE DUKE and SIROCCO were sent for sampling.

O Doleuze (BOBO DUCK) dropped his whip 50 Metres before the winning post.
