Racing Incident Report

FANTASTIC WIN and MY EGO were slow to begin. CAPABEL began awkwardly and then bumped with FOUR ACES. From the outside barrier, SPEEDING MOLLY raced wide and without cover throughout. Near the 1000 Metres, AFRICAN FOREST (T Mundry) shifted from a three wide position to a four wide position and in turn FOUR ACES shifted to take up a three wide position inside AFRICAN FOREST. This allowed ZERO IN to shift from the rail behind TSZ WAN FORTUNE which was severely hampered at that stage to the inside of FOUR ACES. Shortly after this, ZERO IN and FOUR ACES were steadied when crowded for room between TSZ WAN FORTUNE and AFRICAN FOREST which at that time shifted back to a three wide position. DETERMINATION, which was following FOUR ACES, was checked in consequence. The Stewards formed the opinion that while this crowding resulted from AFRICAN FOREST shifting back to a three wide position, it was in the circumstances unreasonable to have expected T Mundry to be aware ZERO IN had shifted away from the fence and improved on his inside. Therefore no action was taken. Near the 100 Metres, BEAUTY PLUS became unbalanced when being steadied away from the heels of AFRICAN FOREST which itself was steadied and shifted in away from the heels of ZERO IN (F Coetzee) which at this time was shifting out when not properly clear. F Coetzee was reprimanded and told in similar circumstances he would be expected to stop riding and straighten his mount sooner than he did on this occasion. The Stewards deferred the declaration of weighed-in as they were of the view an incident had occurred near the 1100 Metres which cast doubt on whether SUPER CHARGE should be declared the winner of the race. W M Lai, the rider of TSZ WAN FORTUNE, second placegetter, also lodged a protest/objection against SUPER CHARGE (M Zahra) being declared the winner alleging interference to his mount near the 1200 Metres. The Stewards on all the available evidence were of the opinion that whilst near the 1100 Metres TSZ WAN FORTUNE was severely hampered when crowded for room inside CHAMP DRAGON which was carried in by SUPER CHARGE, they did not consider bearing in mind the incident occurred near the 1100 Metres and the effect on the running position of TSZ WAN FORTUNE that TSZ WAN FORTUNE would have finished in front of SUPER CHARGE had the interference which did take place not occurred. Accordingly the Judge's placings as semaphored were confirmed. At a subsequent inquiry, M Zahra was found guilty of a charge of careless riding [Rule 100(1)] in that near the 1100 Metres he permitted his mount to shift in when insufficiently clear of CHAMP DRAGON, causing that horse to be taken in onto TSZ WAN FORTUNE which was severely hampered. In the circumstances of this case, the Stewards believed the appropriate penalty was for M Zahra to be suspended from riding in races for a period to expire on Sunday 9 May 2004 on which day he may resume race riding (3 Hong Kong racedays). The commencement of the suspension was deferred until after the Sha Tin meeting next Wednesday 28 April 2004. When questioned, W C Marwing (DETERMINATION) said entering the Straight he was racing behind and between ZERO IN and BEAUTY PLUS. He said on straightening he noted the rider of BEAUTY PLUS shift his horse out into clear running and he felt that horse would go on, he therefore elected to shift out to be in a position to follow BEAUTY PLUS, however, that horse did not quicken which meant DETERMINATION was then held up for running behind SPEEDING MOLLY, outside FOUR ACES and inside BEAUTY PLUS. He said for some distance he remained held up, near the 200 Metres steadied and shifted to the outside of BEAUTY PLUS into clear running. W C Marwing did say he had considered in the early part of the Straight following ZERO IN through towards the inside, however, he was concerned that horse would beat him to any runs that would become available and he would have difficulty obtaining clear running. He said it was primarily for this reason when BEAUTY PLUS shifted out early in the Straight that he elected to go to the outside. W C Marwing was told his explanation would be recorded, however, he should at all times be aware of alternative options available to him. ZERO IN, SUPER CHARGE and TSZ WAN FORTUNE were sent for sampling.
