Racing Incident Report

SUPREME STAR left the gates awkwardly, shifted out and made contact with the hindquarters of SENSIBLE WAY. OCEAN ACROSS missed the start slightly, shifted ground and as a consequence of this HENNESSY STAR was crowded onto GRACIOUS FELLOW and checked. In the early stages, SUPREME STAR proved difficult to settle and for some time raced with its head in the air initially when awkward behind RUN AND WIN. About the 300 Metres, LUCKY LAD was steadied when awkward between RUN AND WIN and SOUTH CHINA NINETY which was weakening and hanging out. The Stewards deferred the declaration of Weighed-In. They were of the prima facie view that an incident had occurred in the Straight which cast sufficient doubt on whether RUN AND WIN should be declared the second placegetter. They decided that there was justification to have the matter resolved openly and formally at an objection hearing [Rule 151(iv)]. Following the conduct of a formal hearing, the Stewards, on all the available evidence before them, were of the opinion that in the Straight RUN AND WIN shifted out at about the 200 Metres, forcing SENSIBLE WAY onto SUPREME STAR which became unbalanced and lost running to which it was rightfully entitled. It was further established that RUN AND WIN again shifted out at about the 150 Metres, causing further inconvenience to SENSIBLE WAY and again indirectly to SUPREME STAR. The Stewards were satisfied that the interference caused to SUPREME STAR albeit indirectly by RUN AND WIN had caused interference to SUPREME STAR, the material extent of which exceeded the neck margin between SUPREME STAR and RUN AND WIN at the finish. Therefore they decided that RUN AND WIN should be placed immediately behind SUPREME STAR and accordingly the placings were amended to read: LUCKY LAD, 1st; SUPREME STAR, 2nd; RUN AND WIN, 3rd and MY JOY, 4th. It was subsequently established that near the 300 Metres, MY JOY was checked when disappointed for running between SENSIBLE WAY and RUN AND WIN (A Marcus) which shifted out abruptly. RUN AND WIN then continued to shift out, causing inconvenience to SENSIBLE WAY and to SUPREME STAR, both of which were taken from running to which they were rightfully entitled. For some distance after this, RUN AND WIN raced truly, then again about the 150 Metres commenced to shift out as SENSIBLE WAY was being taken in slightly by SUPREME STAR. RUN AND WIN continued to shift out whilst being ridden along by A Marcus with the whip in the left hand, as a consequence of this SENSIBLE WAY was checked and SUPREME STAR was again inconvenienced and carried from running to which it was entitled. The Stewards were conscious that RUN AND WIN was having its second race start today and last week raced greenly and hung out badly over the concluding stages which required A Marcus on that occasion to stop riding and straighten. The first incident in today's race was mainly attributable to RUN AND WIN again racing greenly and shifting ground abruptly. In respect of the second incident which occurred after the 200 Metres, the Stewards could not be satisfied to the desired extent and although this was a borderline case, they decided that A Marcus should be given the benefit of a very slim doubt and took no direct action against him, but he was told a severe reprimand would be recorded and in similar circumstances he must stop riding and straighten. OCEAN ACROSS was sent for clinical veterinary examination and routine testing. After the race, OCEAN ACROSS was examined by the Veterinary Surgeon. He said the horse was lame in its near side front leg. Before being allowed to race again, OCEAN ACROSS will be required to perform satisfactorily in an official barrier trial and will be subjected to an official veterinary examination.
