Racing Incident Report

The Stewards interviewed Mr A T Millard, Trainer of ROMANTIC SYMPHONY, and J Egan regarding J Egan having been declared to ride both ROMANTIC SYMPHONY and TRIPLE EXPRESSO. It was established that at entry time J Egan had taken a firm commitment to ride ROMANTIC SYMPHONY, but before declaration time realized TRIPLE EXPRESSO was to run and recommitted himself to that horse. However, Mr Millard, despite having been advised of J Egan's unavailability, was of the view he had firmly engaged J Egan and notified him as the rider of ROMANTIC SYMPHONY at declaration time. J Egan was fined $2,000 for accepting a firm commitment to ride ROMANTIC SYMPHONY and then not fulfilling that commitment. Mr Millard was fined $2,000 for declaring J Egan for ROMANTIC SYMPHONY after being formally advised that he was not available for the ride. Whilst parading behind the Start, ROMANTIC SYMPHONY was kicked by another runner. The horse was examined by the Veterinary Surgeon, no abnormalities were detected and ROMANTIC SYMPHONY was passed suitable to race. Just before the gates were officially released, PRIME WITNESS lunged forward and made contact with its gates. As a consequence, its gates were opened marginally before the others. On jumping, TRIPLE EXPRESSO and TAJASUR came together. ROMANTIC SYMPHONY and SCHUBERT were slowly away. In the early stages, BEST OF THE BEST raced tight outside PLENTY-PLENTY. About the 500 Metres, TRIPLE EXPRESSO shifted out away from CLIFFHANGER and brushed WIND PURSUER. About 200 Metres out, PRIME WITNESS was steadied when crowded between CLIFFHANGER and PLENTY-PLENTY which shifted in. On returning to scale, W Woods (KENWOOD MELODY) and Mr L Fownes, Trainer of the horse, expressed the view that in their opinion KENWOOD MELODY may have had an unfair start. W Woods said after being boxed an attendant was assisting to steady KENWOOD MELODY and he thought the horse was still being held when the gates opened. The Stewards however were of the view that the attendant had released KENWOOD MELODY before the gates opened. KENWOOD MELODY then came out awkwardly, bounded in the air, threw its head about and lost quite an amount of ground. The Stewards were of the view it would be inappropriate for them to invoke their powers under Rule 28(ix) and declare KENWOOD MELODY a non-starter. Accordingly Weighed-In was semaphored.
