Racing Incident Report

After arriving at the Start, W Woods (SEA PEARL) reported to the Veterinary Surgeon that the horse in his opinion had worked down in a lethargic fashion. The Veterinary Surgeon examined SEA PEARL and after the necessary consultations said the horse was suitable to race. In the early stages, FAIR LADY hung in. Near the 800 Metres, when EXCELLENCE FOREVER improved inside JADE RUYI, JADE RUYI was carried onto the heels of FAIR LADY, became unbalanced and was steadied. An inquiry into the reason for FAIR LADY, EXCELLENCE FOREVER and NAMJONG BEAUTY falling at about the 600 Metres was adjourned to a date to be fixed. When the fall occurred near the 600 Metres, JADE RUYI was severely hampered, SPEEDY FORWARD was inconvenienced and HARMONY PRINCE was severely checked. On the turn, JADE RUYI was momentarily crowded by SPEEDY FORWARD which was racing tight inside STRATEGIC MOVE. During the incident, D Whyte (JADE RUYI) lost the use of his near side iron. D Whyte regained the use of this iron at about the 200 Metres. Before weighed-in, M Cahill (HAPPY FORTUNE) sought permission to view the available videos as he was of the view there may have been grounds to object against runners which had finished in front of him. After viewing the available films, he decided this was an inappropriate occasion for him to be formally objecting against either SUPER SPLENDID or RISING INDEX. The Stewards deferred the declaration of weighed-in. They were of the prima facie view that an incident had occurred in the Straight which cast sufficient doubt on whether RISING INDEX should be declared second placegetter. They decided there was justification to have the matter resolved formally and openly at a protest/objection hearing (Rule 123). Apprentice S K Sit, the rider of SUPER SPLENDID, third placegetter, also lodged a protest/objection against RISING INDEX (F Coetzee) being declared 2nd placegetter alleging interference to his mount at about the 200 Metres. Following the conduct of a formal hearing, the Stewards on all the available evidence were of the opinion that RISING INDEX shifted out abruptly under pressure after the 200 Metres, carried SUPER SPLENDID from the running to which it was rightfully entitled and caused interference to it. The Stewards formed the opinion that SUPER SPLENDID would have finished ahead of RISING INDEX had the interference which clearly took place not occurred. In reaching this decision, the Stewards were conscious of the short head margin between the two runners at the end of the race. After sustaining the objection, the Stewards placed RISING INDEX behind SUPER SPLENDID [Rule 101(2)]. Accordingly the amended placings became SEA PEARL 1st, SUPER SPLENDID 2nd, RISING INDEX 3rd, and HAPPY FORTUNE 4th.
