Racing Incident Report

FAT CHANCE and MASTERY were slow to begin. On jumping ELEPHANT DANCE and SUPER SPRINT bumped. Making the first turn and again making the turn after the 700 Metres, ELEPHANT DANCE hung out. For the major part of the race, FREEBIRD and WINNING SUNSHINE raced wide and without cover. Near the 1200 Metres, WEALTHY TREASURE bumped the running rail and was checked when crowded for room inside SUPER SPRINT (Apprentice H W Lai) which when being steadied shifted in to a position behind REWARD when not clear of WEALTHY TREASURE. Shortly after the 1200 Metres, WEALTHY TREASURE was again steadied when crowded for room inside SUPER SPRINT which shifted in. Having considered the relative inexperience of Apprentice Lai, the Stewards in the circumstances severely reprimanded him and told him that he must exercise far more care than he did on this occasion. Making the turn at the 700 Metres, FREEBIRD hung out. For some distance approaching and passing the 600 Metres, WEALTHY TREASURE, which was following SUPER SPRINT, was carried back through the field as SUPER SPRINT itself was carried back through the field by REWARD which commenced to give ground. Near the 400 Metres, BY INSTINCT broke down. Inconvenience was caused to FAT CHANCE and ELEPHANT DANCE which were carried wider on the track. Also near the 400 Metres, SUPER SPRINT, which was endeavouring to shift to the outside of the heels of REWARD which was giving ground, was crowded for room inside CARACOLER. In this incident, CARACOLER also became unbalanced. The performance of REWARD, which tailed out, was considered unacceptable. Before being allowed to race again, REWARD will have to perform competitively in an official barrier trial and be subjected to an official veterinary examination. The Stewards deferred the declaration of weighed-in. They were of the prima facie view that an incident had occurred after the 100 Metres which cast sufficient doubt on whether FREEBIRD (C Williams) should be declared the winner of the race. A Marcus, the rider of LUCKSWELL, 3rd placegetter, also lodged two protests/objections, the first against SONGS OF PRAISE being declared the second placegetter alleging interference to his mount inside the final 100 Metres; the second against FREEBIRD being declared the winner of the race alleging interference to his mount inside the final 100 Metres. Y T Cheng, the rider of SONGS OF PRAISE, 2nd placegetter, also lodged a protest/objection against FREEBIRD being declared the winner of the race alleging interference to his mount inside the final 100 Metres. Following the conduct of a formal hearing, the Stewards on all the available evidence were of the opinion that by continually shifting in and carrying SONGS OF PRAISE from the running to which it was rightfully entitled and causing crowding on its inside to LUCKSWELL which as a result lost the running to which it was rightfully entitled, FREEBIRD had caused interference to LUCKSWELL and SONGS OF PRAISE. The Stewards formed the opinion that LUCKSWELL would have finished ahead of FREEBIRD had the interference which clearly took place not occurred. The Stewards also formed the opinion that SONGS OF PRAISE could not be held responsible for the interference which clearly occurred to LUCKSWELL. Having formed these opinions, the Stewards sustained the protest/objection of LUCKSWELL against FREEBIRD and overruled the protest/objection of LUCKSWELL against SONGS OF PRAISE. In sustaining the protest/objection, the Stewards placed FREEBIRD immediately behind LUCKSWELL [Rule 101(2)]. Accordingly the amended placings became 1st, SONGS OF PRAISE; 2nd, LUCKSWELL; 3rd FREEBIRD, and 4th FAT CHANCE. Having sustained the protest/objection 3rd against 1st, the Stewards were not required to determine the protest/objection 2nd against 1st. At a subsequent inquiry, C Williams pleaded guilty to a charge of careless riding [Rule 100(1)] in that he had failed to take sufficient measures to prevent his mount from shifting ground in this incident. C Williams was suspended from riding in races for a period to expire on Thursday 22 April 2004 on which day he may resume race riding (4 Hong Kong racedays). The commencement of the suspension was deferred until after the Sha Tin meeting next Saturday 3 April 2004. FAT CHANCE, SONGS OF PRAISE and LUCKSWELL were sent for sampling.
